Good day! I am an Architect working at Tecom area in Dubai with an operations manager visa. I have a problem with my resignation as the company do not want me to go.
I've been working in my company since July 1, 2014. On November 24, 2015, I submitted my formal notice for resignation and render a 30 days noticeto be effective by December. But my manager do not want me to go. They offer me an increment but I got less interested as they promised me this over a year ago before I signed the contract that i can enjoy an increment after my 6 months in service, then they say, after my 1 year but nothing happens. Making me push more on my plans for my career and at the same time on my family life and book a flight home after my notice to take effect.
When they realize they cant keep me by that, they start threatening me that its a breach of contract, that they will sue me, this and that… and would face a very serious legal problem etc. and a ban in UAE. Making me start thinking about my security as I am a family guy with 2 dependents. Then weeks later, my manager talked to me again in a very humble manner as he really wants me to stay. That all he can do is offer an increment for me and is asking me to accept it. While my 30 days notice and flight back home is fast approaching, still, no formal and legal arrangement has been given to settle my status in the company and to backup their intention not to turn it as another promises like they did before.
Yet again, after my last day, I realize it was a complete delaying tactics, no arrangement or anything. I didn't get my salary, settlement or other benefits that I deserve and decided to take my flight as I also have other opportunity scheduled back home and some other concerns.
I send my passport to my colleague to hand it to the company to cancel my visa. It is then I realized that I have an absconding case and they refuse to stamp a cancellation for my visa. It's a very serious accusation for me to take from the fact that I formally submitted and served a 30 days notice for resignation. And that I returned the laptop issued upon me and specially that I didn't get my salary and settlement. I still have emails regarding my case to backup my statement.
Please help me about my case and is looking forward for your response. I am now in the Philippines and I cannot come back to Dubai to defend myself, claim my settlement and everything. I now realize that this must be the idea why they delayed everything so I cannot claim anything from them. Thank you and wish you sustained success.
